It is important that you understand how we collect, use, and maintain your information. This Privacy Policy deals with personally identifiable information (referred to as “Data” below) that may be collected by us on our site and through related communications channels, including telephone calls placed or received by our automated voice agent. This Policy does not apply to other entities that we do not own or control or persons that are not our employees, agents or within our control.
By using the 1nHealth website, by interacting with our automated voice agent, or by using any 1nHealth services, you are agreeing to the terms of this Privacy Policy.

Summary

1nHealth Inc. (“we,” “us,” or “our”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use, and disclosure of information we receive from users of www.1nhealth-studies.com (“the Site”) and from individuals who interact with our automated voice agent during the study qualification process. We are committed to respecting your privacy and complying with all applicable United States data, web, and telecommunications privacy laws, including HIPAA and the Telephone Consumer Protection Act (TCPA).

Information We Collect

We collect personally identifiable information (“PII”) from you when you apply to a study, answer related eligibility questions, or speak with our automated voice agent. PII may include your name, address, phone number, email address, date of birth, and health information/history.
When you interact with our automated voice agent, we additionally collect:

  • Audio recordings of your conversations with the voice agent.
  • Transcripts generated from those recordings using automated speech-to-text technology.
  • Structured eligibility responses derived from the conversation (for example, yes/no answers to screening questions, reported conditions, medications, or other study-relevant data points).
  • Call metadata, including the date and time of the call, call duration, the phone number used, and whether the call was inbound or outbound.

Your PII, voice recordings, and transcripts are kept confidential and will never be disclosed unless we are required to do so by law or as described in this policy.
We also collect non-personal information such as anonymized IP addresses, browser types, and other demographic or statistical information. We gather this type of analytical information on an aggregated basis on all visitors to our website. All non-personal information collected from you may be used and shared with third parties on an anonymous or aggregated basis only.

Purpose of Your Data

Our mission is to connect patients to study opportunities. To ensure that you qualify for a given study, we may ask questions related to your health-state in addition to your contact information. By filling out and submitting a form on our website, you acknowledge our right to contact you by telephone (including by automated voice agent), email, or SMS to provide you with specific information on how to connect to a study opportunity you have expressed interest in.

In addition to the information we collect and share as described in our Privacy Policy, we may also share information obtained during the qualification process — including information collected through automated voice agent calls — with study personnel. This information may include your name, address, phone number, email address, date of birth, health information/history, voice agent transcripts, and structured eligibility responses. This information will be shared in order to assess your eligibility for studies and to provide you with more information about studies that may be a good fit for you.

We will share the information only as it is required to the support teams operating the clinical trial in collaboration with the study sponsor. To find your study’s sponsor and/or collaborating partners, view the privacy statement at the bottom of the page for the study to which you wish to apply. We will not share your information with any third parties for marketing or advertising purposes. We do not and will never sell your personal data.

Voice Agent and Automated Communications

After you submit a study application form, we may contact you by telephone using an automated, AI-powered voice agent to complete the eligibility qualification process. This section explains how the voice agent works, what information it collects, and your rights.

Pre-Call Notice

Before the voice agent calls you, you will receive a text message and/or email confirming that you have been forwarded for further qualification and informing you that an automated call from 1nHealth will follow shortly. This pre-call notice gives you the opportunity to opt out before the first call is placed.

Disclosure at the Start of Each Call

At the start of every call, the voice agent identifies itself as an automated, AI system operated by 1nHealth and notifies you that the call will be recorded for quality assurance, eligibility documentation, and study-related purposes. The voice agent will only proceed with the screening questions after this disclosure has been delivered.

Consent

By submitting a study application form on our Site and providing your phone number, you consent to receive telephone calls — including calls placed by an automated voice agent — and SMS messages at the number you provided, regarding the study you applied to and other studies for which you may be eligible. This consent is not a condition of receiving any goods or services. You may revoke this consent at any time as described in the Opt-Out section below, including by replying STOP to any SMS message we send you, which will end all automated calls, callbacks, and text messages associated with your record.

How the Voice Agent Works

The voice agent conducts a structured, scripted conversation that mirrors the eligibility questions reviewed and approved by the study’s Institutional Review Board (IRB). The voice agent does not provide medical advice, does not diagnose, and does not enroll you in a study. Its sole purpose is to gather the information needed to determine whether you may be a fit for a particular study and to facilitate next steps with study personnel.

Depending on the outcome of the conversation, the voice agent may (i) determine that you do not appear to qualify for the studies it is screening for and end the qualification process, (ii) determine that you appear to qualify and forward your information to the appropriate study site for follow-up, or (iii) at your request, route you to a human representative for follow-up by phone.

If you do not answer the initial call, the voice agent may attempt a limited number of follow-up callbacks at reasonable intervals. You may stop these callbacks at any time by replying STOP to any SMS we send you, by telling the voice agent on a call to remove you, or by contacting us using the information in the How to Contact Us section.

Conversations with the voice agent are processed using automated speech recognition and natural language understanding technologies. Your spoken responses are converted to text, evaluated against the IRB-approved screening criteria, and stored in our HIPAA-compliant data portal alongside the rest of your application.

Recording Is Required to Complete a Voice Agent Call

For accuracy, auditability, and compliance with the IRB-approved protocol, all voice agent calls are recorded and transcribed. If you do not wish to be recorded, you may decline at the start of the call; the voice agent will end the call and will not capture screening responses through the automated channel. In that case, you may still continue the qualification process by requesting a callback from a human representative or by contacting us directly using the methods in the How to Contact Us section. Declining recording will not affect your underlying eligibility for any study.

Storage and Retention

Recordings, transcripts, and structured eligibility data generated by the voice agent are stored in a secure, HIPAA-compliant environment with the same protections that apply to the rest of your PII (see Data Storage below). Recordings and transcripts are accessible only to authorized 1nHealth personnel and to study personnel who have a legitimate need to access the data to assess your eligibility or to support your participation in a study.

We retain voice recordings and transcripts for the period required by the study protocol and applicable law, after which they are securely deleted. You may request deletion of your recordings and transcripts at any time, subject to applicable legal and regulatory retention obligations.

Use of Recordings for Quality and Safety

We may use recordings and transcripts to monitor the quality, accuracy, and safety of the voice agent, including reviewing calls for compliance with the IRB-approved script, identifying technical errors, validating the agent’s eligibility decisions, and improving the agent’s performance for future use. We do not use your recordings or transcripts to train third-party general-purpose AI models, and we do not sell or license your voice data.

Sub-Processors

The voice agent is operated with the assistance of Retell AI, a third-party voice technology provider that acts as a sub-processor for the telephony, speech recognition, and conversational components of the service. In addition, we may use sub-processors for SMS delivery, telephony carriage, secure data hosting, and analytics. Each sub-processor is bound by a written agreement that requires it to (i) maintain appropriate administrative, physical, and technical safeguards, (ii) use your information solely to provide its service to 1nHealth, and (iii) comply with HIPAA where applicable, including by entering into a Business Associate Agreement (BAA) with 1nHealth. Your Rights Regarding the Voice Agent

You have the right to:

  • Decline to speak with the voice agent and request a human representative instead, at any point during a call or by contacting us in advance.
  • Decline to have your call recorded; in that case the voice agent will end the call, and you may complete qualification with a human representative.
  • Opt out of automated calls and SMS entirely (including by replying STOP to any SMS) while remaining a candidate for a study; a member of our team can complete qualification by other means.
  • Request a copy of the recording or transcript of any call you had with the voice agent.
  • Request that we delete the recording and transcript of any call, subject to applicable legal and regulatory retention obligations.

Opt-Out

You can opt out of any and all communication — including calls from our automated voice agent, SMS messages, and emails — as well as opt out of having your information shared with study personnel by contacting us as directed below. To opt out of voice agent calls specifically, you may also tell the voice agent during a call that you wish to be removed, and we will honor that request.

Children Under the Age of 16

Our website and voice agent are not intended for the use of children under 16 years of age, and we do not knowingly collect PII from any child under 16 without consent from their parent(s) or legal guardian(s).

If we learn we have collected or received PII — including voice recordings — from a child under 16 without parental consent, we will delete that information immediately. If you are a parent or guardian and are concerned about the transfer of PII about your child, please contact us at info@1nhealth.com.

Data Integrity

We take all reasonable steps to ensure that PII collected — including data collected through the voice agent — is reliable for its intended use and that it is accurate, complete, and current. If you believe any information we have collected about you is inaccurate, including any transcribed voice agent response, you may request correction as described in the Legal Rights to Your Data section.

Data Storage

When you submit information for a specific study or interact with our voice agent, 1nHealth stores your information — including voice recordings, transcripts, and structured eligibility responses — in a secure, HIPAA-compliant data portal. The data portal is designed to ensure the confidentiality, integrity, and availability of your personal data. It is accessible only to authorized personnel who have a legitimate need to access the data for the purposes of facilitating your participation in the study. You have the right to request any and all information stored about you in the data portal, as well as the right to request your data to be deleted at any time, subject to applicable legal and regulatory retention obligations.

Legal Rights to Your Data

As a user of our services, you have legal rights to the data that we collect and store on your behalf, including data collected through the voice agent. These rights are determined by the laws and regulations that apply to your specific location and the type of data being collected. We are committed to respecting your legal rights to your data, which may include:

  1. Right to Access: You have the right to request access to the personal data we have collected about you, including voice recordings and transcripts. This includes the right to know what data we have collected, why we collected it, and who we have shared it with.
  2. Right to Correction: If you believe that any of the personal data we have collected about you is inaccurate — including any transcription of a call with the voice agent — you have the right to request that we correct it.
  3. Right to Erasure: You have the right to request that we delete the personal data we have collected about you, including voice recordings and transcripts. This may be applicable if the data is no longer necessary for the purposes for which it was collected or if you have withdrawn your consent to its processing, subject to applicable legal and regulatory retention obligations.
  4. Right to Object: You have the right to object to the processing of your personal data in certain circumstances, including the right to object to being contacted by an automated voice agent.
  5. Right to Data Portability: If you have provided us with your personal data, you have the right to receive that data in a structured, commonly used, and machine-readable format, and to transmit that data to another data controller.

Data Security

We take the appropriate measures to guard Personal Data — including voice recordings, transcripts, and other voice agent data — from any form of loss, alteration, or misuse. We use commercially acceptable means to protect your Personal Data, including encryption in transit and at rest, access controls, audit logging, and contractual safeguards with sub-processors, but we cannot guarantee it is absolutely secure. If any breach of data occurs such as a data loss or alteration, or unauthorized disclosure, access, or transmission of data, we will promptly notify affected individuals, as required by law, and provide them with information about the breach, including the type of data involved, the potential harm to affected individuals, and the steps they can take to protect themselves.

Service Providers

We may employ third party companies or individuals to provide services related to the purposes of this site and our voice agent, or to assist us in analyzing how our services are used. This includes the third-party voice technology provider that powers our automated voice agent, as well as providers of telephony, transcription, hosting, and analytics services. These third parties have access to your PII only to perform these tasks on our behalf and are obligated by written agreement not to disclose or use it for any other purpose. Where the services involve protected health information, these providers operate under a Business Associate Agreement (BAA) with 1nHealth.

Third-Party Websites

Your relationship with third-party websites is governed solely by your agreement with said third-party website. We are not responsible for the privacy practices of these websites.
